FI PPP Portal Tools: Terms of use
Your use of the FI PPP Portal Tools maintained by CONCORD (Future Internet PPP Programme Facilitation and Support action) and the user name and password provided for you for the FI PPP Portal Tools are subject to the following terms of use, which you acknowledge that you have read, understood, and agree to be bound by and which you are deemed to accept each time you use the FI PPP Portal Tools.
User name and password
You acknowledge and agree that your user name and password for the FI PPP Portal Tools are personal and shall not be distributed to anyone. You agree and acknowledge that the user name and password for FI PPP Portal Tools are granted for you as a representative of your current employer or another legal entity participating in the FI PPP Program or otherwise connected to the FI PPP Program and you shall cease to use the user name and password once your are no longer employed by your current employer or representing the legal entity in question.
It is your responsibility to verify and maintain the protection and security of your user name and password associated with the FI PPP Portal Tools. Furthermore, you expressly agree that all liability relating to user name and password management resides with you and that you are fully responsible for all activities that occur under your user name or password and that under no circumstances, including negligence or misconduct, shall CONCORD or any of the legal entities participating in CONCORD be liable for any damages that result from the use or misuse of your username or password for the FI PPP Portal Tools.
You agree to allow CONCORD to store (and transfer, if necessary) your personal information requested for registering you as a user of the FI PPP Portal Tools in the servers and/or other storage media situated within the European Union. Such information will not be used for any other purposes than granting you the user name and password for the Tools and administrating the FI PPP Portal Tools. You are entitled to review any such personal information regarding yourself and, if incorrect, have it corrected by contacting [email protected].
Information on the FI PPP Portal Tools
CONCORD maintains FI PPP Portal Tools for the stakeholders of Future Internet PPP Programme. Information and material on the FI PPP Portal Tools are uploaded and submitted in addition to CONCORD by the users of the Tools and is protected by copyrights and/or other intellectual property rights belonging to CONCORD and/or the users of the Tools. All information and material are provided by CONCORD "as is," with no warranties or guarantees whatsoever. CONCORD and the entities participating in CONCORD expressly disclaim the warranties of non-infringement of proprietary and intellectual property rights of any third parties.
CONCORD’s aim is to keep the material and information submitted by it timely and accurate but in no way are we controlling or able to control the information and material submitted on the site by the users of the Tools. If errors are brought to our attention, we will try to correct them or to have them corrected.
Using and submitting information
Using the FI PPP Portal Tools and any information and material which is available on the FI PPP Portal Tools is at your sole risk.
Uploading, submitting or otherwise making available or contributing to the FI PPP Portal Tools any information or material is at your sole risk. You are entirely responsible for all material and information that you upload or submit to the Tools and for having sufficient rights to upload or submit the information or material in each specific case to the Tools. In particular you acknowledge all the foregoing when uploading or submitting confidential information to the FI PPP Portal Tools.
Liability and indemnity
CONCORD or any of the legal entities participating in CONCORD accepts no responsibility or liability whatsoever with regard to the information and material on the FI PPP Portal Tools. In particular, CONCORD or any of the legal entities participating in CONCORD accepts no responsibility or liability whatsoever with regard to the information or material, whether non-confidential or confidential, which has been uploaded or submitted on the Tools by the users of the Tools.
You agree to indemnify and hold CONCORD and any of the legal entities participating in CONCORD harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of information or material you upload or submit to the FI PPP Portal Tools, your use of the Tools, your connection to the Tools, your violation of these terms of use or your violation of any rights of another.
The information and material on the FI PPP Portal Tools may sometimes be linked to external sites over which CONCORD or any of the legal entities participating in CONCORD has no control and for which CONCORD or any of the legal entities participating in CONCORD assumes no responsibility.
It is our goal to minimize disruption caused by technical errors. However some data or information on our site may have been created or structured in files or formats that are not error-free and we cannot guarantee that our service will not be interrupted or otherwise affected by such problems. CONCORD or any of the legal entities participating in CONCORD accepts no responsibility with regard to such problems incurred as a result of using this site or any linked external sites.
Changes to terms of use and invalidity
These terms of use may be changed by CONCORD at any time. You will be deemed to accept the terms of use (as amended) when you next use this site following any amendment.
If any provision of terms of use is held to be invalid by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
Applicable law and dispute resolution
Any disputes arising out of or in relation to the use of this website or application of these terms of use shall be subject to the laws of Finland, excluding its choice of law rules, and shall be resolved in the first instance exclusively in the District Court of Helsinki, Finland.
